被公司HR擺了一道不得不離職! 請幫助我~~~

現在回到家可以打中文了
所以想在詳細敘述一下  希望有經驗的人可以幫幫忙

我在七月中旬拿到CDI合約  立刻就去了學生事務中心拿表格  要換成工作居留
之後交給"看起來經驗老到"的HR經理  他也說他會開始辦

九月中 (12號)  他說他已經寄出表格  但是一直沒有回應  很怕我知後的居留有問題
                        所以在我適用期(9/15, 兩個月)屆滿之前先解約   有居留證時再回來
                        我很驚訝的問他   那份表格也有很多我要填寫的地方
                        為什麼就降寄出了??? 他回答的不清不楚
                        我又問   那ANPE的公告有登嗎? 他居然回答"不需要啊~~"
                        我知道我完蛋了
                        (附註)  我查看合約  試用期是一個月而不是兩個月
九月15號         也就是今天   我去了一趟警署   她們說她們什麼也沒收到  娃??????
                        今天   HR結清了這個月的薪水給我

九月30號          學生居留到期

真是一場羅生門!!!我跟那個HR一週見到一次面都難! 幹嘛要這樣搞我???

明天我會再去一趟學生事務中心  看看能不能再拿一份表格 (有人有拿兩次的經驗嗎??)
我可以當場拿到三個月的recepisee嗎?   可以工作麼?
還有我要如何要回我的工作卻又不傷和氣呢? 那個HR可是老闆很倚重的人

如果你有b+5其實很快唷
至少可以先用cdd轉cdi,所以不用太担心
至於轉身份你可以自己去prefecture拿表格,把裡面的東西自己可以準備的先準備
希望公司可以提供的自己再催hr那
匠會比較有保障,因為很多東西都要hr這替你弄,所以你和他的關係不要先打壞
也要請他一定要去APEC或ANPE那登求職訊息,不然好像不太合法
反正他準備好東西時,你可以自己去prefecture交件,那時就沒什問題了

最近應該很多學生都打算轉工作千
大概要在拘留到期前多久就要提出會比較保險?
也就是說我簽約拿表格之後
多久之後可以拿到工作證??

Paris's case (1-20 arrond.)
By HR (huge company, a lot of foreigners) or by lawyer(first month salary to pay the admin. fee):1.5-2 monthes without any public vacation.
By oneself: normally 3-3.5 monthes; save money and also you can afford the risk of working permit refusal.

You have to understand one thing:
Before and during the process of change the title from "etudiant" to "salari&eacute;", you don't have the right to work as a full time employee. But you may work as a trainee.

In your case, the company lets you (student) work during 2 monthes with a CDI (full time), it is not a legal way.

Now, if the company could give you a simple letter to promise the engagement with a reasonable salary and will also give you a long term contract in the near future to complete the change of status(from student to employee), you may ask the documents to continue the process.

Without any valid letter or contract, the laywer can NOT give you any help in your case.

About the 3-month temporal resident permit, it depends on you actual situation.

About getting the 3-month temporal resident permit to work, what you think is beyond the real world.

今天去了一趟cite universitaire, 轉身分的人很非常多(到今年12月16號止  都在這兒辦  而且只有下午13:30以後才辦理)
但是還是拿到了新的表格(我說公司的人弄丟了)
還拿到三個月的recepisse(從今天開始算日子)  上面註明可以工作
我問了在場的其他人還有也在辦轉換的朋友
他們拿的recepisse都可以工作
所以我想是沒有大問題的
還有我看到公佈欄說
如果已經寄出表格但是尚未回覆  而recepisse又將到期
可以去那個收件地址的辦公室辦理延長

我也問了是否一定要在anpe上登廣告兩個月
馬旦說  有一些大公司並不這麼作  也就降寄出了
只是端看勞工局的人認為你的工作的重要性有多少
是不是特殊的行業 等等

還有她說  她看到很多被拒的例子其實很鳥: 申請著(學生) 忘記在三聯式的合約上簽名....這是一定被拒的
總之他說  一般而言  好好的乖乖的跑流程  都是會成功的

In my last mail, I said clearly that you can work with your temporal resident permit as TRAINEE not a full time employee because the permit title is "Student".

So you now got your 3-month temporal resident permit, you may work  in maximum of 964 hours during 2008. If you run out of this quota, you could not work anymore legally.

The only thing you get to do is ask the HR to give you a new CDI and all necessary documents to continue the change status process. Without any new contract, you will meet the same pb on December.

Finally, in most of the case I knew, the companies will let foreigners start their work after they totally get the new 1-year temporal resident permit with a title "Salarie" to avoid further pbs.

My suggestion is do not bother the HR to say that you may work now because you get the 3-month permit and ask to work right away...This is because you are still in an UNSTABLE situation. He couldn't know whether you could get the working permit or not. That's why he stopped your last contract.

It's better to let him know that you will change the status as soon as possible and keep in touch with him if you need any document in condition that he gives you a new CDI. Then you have to think one important thing: do you want to do the process yourself or pay your first month salary to a lawyer!

Besides, I want to correct one point in your reply in another topic:

The taiwanese STUDENT can work during his study in France without working permit in maximum of 964 hours/year.

Any non-european citizen needs to apply a working permit if they want to work (full time 35h/week or part time >964 h/year) in Europe.

You have worked as full time employee with your student resident permit during 6 monthes does not mean that you don't need a working permit  if you want to work as a normal employee with a long term contract.

在獲得工作身分的許可前,
不可能用CDI正職雇用...
這是違法的,
真不知道現在是什麼情況...

還有HR準備的東西,
應該是您拿到以後一起寄給préfecture,
我那時還陪朋友郵局排隊接力賽寄雙掛號...
難道現在又改成公司直接寄???
